After years of hearing story after story of men who later discovered through DNA paternity testing, that children they believed were their biological offspring were not, We were in disbelief and saddened.
In most of these cases, the bond between father and child are so strong that no DNA paternity test can reverse or erase that love. A true father knows this, and decides to always be the daddy. This is not a "…and they lived happily ever after", story.
This affects the father tremendously. The child, depending of his/her age is not yet informed, but witness the tension and anger between both parents. Grandparents are also distraught and hurt. Counseling is very much needed for the entire family.
After a while these situations became so common, that we began to hear about it in the workplace, on college and high school campus, in shopping malls, restaurants, gyms, and at family gatherings.
Has anyone considered the child, and how this will affect him/her in the present and future? What if the child has a serious medical condition? Shouldn't the child have the right to know who the biological father is? Shouldn't the biological father have the right to know that he has a child? This effects the father, grandparents, siblings and the entire family.
Why let it escalate to this level of legal chaos and emotional/financial hardship. At this point more children are effected mentally and psychologically, confused and misled which in effect causes problems in school and day to day activities. More money is spent for legal representation; more men go to jail for a crime that really has not been committed (abandonment). In no way is this intended to make a mother feel like she has committed a crime, she must understand the consequences that will arise later on in life for her child, medically, mentally, and emotionally. Mothers who submit to DNA testing are taking the first step in making the Right Choice, and we commend her for it. Education is the key. We encourage fathers to step to the plate and be fathers, and mothers to be mothers, which combined makes loving parents.
We began our journey by conducting months of extensive research and interviews with unwed mothers and fathers in regards to establishing paternity. We soon discovered the mass majority of unwed parents were never tested, unless a child support order was put in place, and even in child support cases; the father either waived his rights, due to lack of education, not informed of rights verbally, or father moved, court order sent to last address, in which a judgement by default was issued.
We wanted to know why paternity was not established soon after birth.
These were some of the reasons:
Most men felt there was not a need for a paternity test, the mother in this case was either his fiancé or long-term girlfriend.
Mothers were 100% certain of biological father.
Alleged father not aware/educated of paternity rights.
Alleged father later requested a paternity test, but the mother once again assured him that he is the father.
Family and Friends of mother assured alleged father that there is a resemblance in the child's features.
We then interviewed cases in which the alleged father was excluded by a DNA paternity test. In these cases the child's average age was between 2-12 years old.
We wanted to know why paternity was established so late in a child's life.
These were some of the reasons:
Mother informs father that there is a possibility of him not being the biological father. (This confession normally takes place during an argument).
Father has moved on, new fiancé or new wife has requested a paternity test.
Child shows no resemblance of father or family members, there is doubt.
Outside source informs father that he may not be the biological father.
Child had a serious medical condition; father's DNA is not a match.
Many men find themselves in situations in which they believed they were the fathers, and are forced by court order to pay child support for other men's children. In 2000, The American Association of Blood Banks (AABB) found that in almost 30% of paternity tests conducted the man being tested was not the biological father.
When fathers have a relationship with their child, most likely they do not walk away. Most fathers feel betrayed and cheated by the system, and that being forced to support a child financially that is not biologically theirs is fraud, and that the mother should be punished and child support paid back. This occurs in cases in which the father has bonded with the child or never seen the child. The paternity fraud law in Georgia (passed in May 2002 Carnell Smith), Alabama, Maryland, and Ohio release dads from past and future child support payments for children proven by DNA testing not to be theirs biologically.
IT IS TIME FOR MEN AND WOMEN TO MAKE THE RIGHT CHOICE; ESTABLISH PATERNITY SOON AFTER THE BIRTH OF THE BABY. IT IS NOT FAIR TO THE CHILD THE ALLEGED FATHER, THE BIOLOGICAL FATHER, GRANDPARENTS AND OTHER FAMILY MEMBERS TO EXPERIENCE THIS AWFUL TURMOIL.
